Challenges of Contemporary Public Management: The Limits Imposed by Legal Provisions on Good Practices

This essay analyzes, from a qualitative perspective, legal provisions that directly influence Brazilian public management, with an emphasis on the normative limits to the adoption of good administrative practices. The investigation focuses on three analytical axes: the reasonableness of the eligibility requirements for holding positions in the Executive Branch, in light of Article 14, §3, of the Federal Constitution; the mechanisms of political accountability applicable to public managers as a result of the rejection of accounts by the control courts; and the absence of a requirement for specific academic training as a conditioning factor for administrative efficiency. The analysis engages with contemporary literature on governance and public management, seeking to problematize the tensions between legality, technical capacity, and quality of public administration. It concludes that the current normative framework presents weaknesses that may compromise the effectiveness of public management and the consolidation of administrative practices aligned with the principles of good governance.
